Welcome to Media Academy. By accessing or using our Academy, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. General

1.1. These terms and conditions govern your use of our Academy and any services provided therein.
1.2. By using our Academy, you acknowledge that you have read, understood, and agree to be bound by these terms.
1.3. We reserve the right to modify these terms at any time, and any changes will be effective immediately upon posting. Your continued use of the Academy signifies your acceptance of the revised terms.

2. Enrollment and Identification

2.1. To enroll in the Academy, you must provide a valid ID for verification purposes.
2.2. By enrolling into our Academy, you confirm your understanding and acceptance of the Academy's rules and regulations upon entry.
2.3. You acknowledge and understand that any breach of these rules may result in legal actions and fines.

3. Content Use and Confidentiality

3.1. All content provided in the Academy is for your personal use only and must not be shared or distributed without explicit permission.
3.2. Unauthorized distribution of content is strictly prohibited and will result in legal consequences.

4. Legal Agreement

4.1. By submitting your ID and enrolling in the Academy, you acknowledge and understand the rules and regulations governing the Academy/Product.
4.2. You acknowledge and understand that any breach of these rules may result in legal actions and fines.
4.3. Furthermore, you acknowledge and understand that any attempt to leak the content or information within this Academy/Product by any means will result in legal consequences.
4.4. In accordance with UAE Federal Law No. 5 of 2012 on Combating Cybercrimes, specifically Article 21, which states:

"Any person who uses an electronic information system or any information technology means to invade the privacy of another person’s private or family life shall be punished by imprisonment for a period of at least six months and a fine not less than AED 150,000 and not in excess of AED 500,000, or either of these two penalties."

4.5. You acknowledge and understand that the Academy reserves the right to pursue legal actions against any individual or entity that damages the Academy or its products, including but not limited to the unauthorized distribution of its content. These consequences apply to individuals both within and outside the UAE.
4.6. By submitting your ID and enrolling in the Academy/Product, you confirm your agreement to these terms and your understanding of the legal ramifications of any violations.

5. Community Conduct

5.1. Any immoral behavior within our communities or actions that negatively impact others will result in an immediate ban from all products and services.

6. Refund Policy – Digital Product & Trial Access

6.1. Free Trial Provided
Before purchasing, every member is given a free trial period of 3 days to access and evaluate the program. This trial period allows the member to determine whether the product is suitable, functional, and valuable for their needs. By the end of the trial period, the member has had a fair opportunity to decide whether to proceed with purchase.

6.2. All Sales Are Final After Trial
Because of the free trial and the digital nature of our product, all sales are final and strictly non-refundable once payment is made, except in the limited cases stated in clause 6.5.

6.3. Mandatory Agreement at Checkout
At the point of purchase, the member is required to tick a checkbox confirming that they have read and agreed to these Terms & Conditions. By completing checkout, the member acknowledges and agrees that:

  • They had a free trial to evaluate the product,

  • They understood that refunds will not be issued after purchase,

  • They accepted these conditions willingly.

6.4. Reasons Refunds Will Not Be Granted
Refunds will not be granted under any of the following circumstances, which are considered invalid dispute reasons:

  • Claiming the product was not liked, not useful, or did not meet personal expectations.

  • Claiming inability to achieve the same results as other students.

  • Claiming lack of time, lack of motivation, or inability to complete the program.

  • Claiming the product was too advanced, too basic, or not what was personally desired.

  • Claiming that access was received but later unused.

  • Attempting to consume all content and then request a refund.

6.5. Only Valid Grounds for Refund
Refunds will only be considered in the following rare cases:

  • The product was 100% not delivered (the member never received access after successful payment).

  • There were verified technical issues that prevented access to the product, despite the member following all instructions and contacting support.

6.6. Digital Product Disclaimer
The member acknowledges that this is a digital product consisting of knowledge, materials, and online access. Digital products cannot be “returned” once accessed. Therefore, offering refunds based on personal preference, satisfaction, or consumption of content is not possible.

6.7. Fraud & Dispute Protection

  • Any attempt to initiate a chargeback or payment dispute after agreeing to these terms is considered fraudulent and a breach of contract.

  • The Academy will provide evidence including: trial access logs, login records, progress data, confirmation of checkbox acceptance, and copies of these Terms & Conditions.

  • In cases of fraudulent disputes, the Academy reserves the right to pursue legal action, claim damages, and recover associated legal fees.

6.8. Final Acceptance
By proceeding with purchase after the trial, the member confirms that:

  • They evaluated the product during the free trial,

  • They had sufficient time to make an informed decision,

  • They accept that no refunds will be issued except for the limited cases listed in clause 6.5.

مرحبًا بكم في أكاديمية ميديا. من خلال الوصول إلى أكاديميتنا أو استخدامها، فإنك توافق على الامتثال لهذه الشروط والأحكام والالتزام بها. يرجى قراءتها بعناية.

١. عام

١.١. تحكم هذه الشروط والأحكام استخدامك لأكاديميتنا وأي خدمات مقدمة فيها.
١.٢. باستخدام أكاديميتنا، فإنك تقر بأنك قد قرأت وفهمت وتوافق على الالتزام بهذه الشروط.
١.٣. نحتفظ بالحق في تعديل هذه الشروط في أي وقت، وستكون أي تغييرات فعالة فور نشرها. استمرارك في استخدام الأكاديمية يعني قبولك للشروط المعدلة.

٢. التسجيل والتحقق من الهوية

٢.١. للتسجيل في الأكاديمية، يجب عليك تقديم هوية صالحة لأغراض التحقق.
٢.٢. من خلال التسجيل في أكاديميتنا، فإنك تؤكد فهمك وقبولك لقواعد ولوائح الأكاديمية عند الدخول.
٢.٣. أنت تقر وتفهم أن أي انتهاك لهذه القواعد قد يؤدي إلى اتخاذ إجراءات قانونية وفرض غرامات.

٣. استخدام المحتوى والسرية

٣.١. جميع المحتويات المقدمة في الأكاديمية هي لاستخدامك الشخصي فقط ولا يجب مشاركتها أو توزيعها بدون إذن صريح.
٣.٢. يُحظر توزيع المحتوى غير المصرح به بشكل صارم وسيؤدي إلى عواقب قانونية.

٤. الاتفاق القانوني

٤.١. من خلال تقديم هويتك والتسجيل في الأكاديمية، فإنك تقر وتفهم القواعد واللوائح التي تحكم الأكاديمية/المنتج.
٤.٢. أنت تقر وتفهم أن أي انتهاك لهذه القواعد قد يؤدي إلى اتخاذ إجراءات قانونية وفرض غرامات.
٤.٣. علاوة على ذلك، فإنك تقر وتفهم أن أي محاولة لتسريب المحتوى أو المعلومات داخل هذه الأكاديمية/المنتج بأي وسيلة ستؤدي إلى عواقب قانونية.
٤.٤. وفقًا للقانون الاتحادي لدولة الإمارات العربية المتحدة رقم ٥ لسنة ٢٠١٢ بشأن مكافحة الجرائم الإلكترونية، وبالتحديد المادة ٢١، التي تنص على:

"يعاقب بالحبس مدة لا تقل عن ستة أشهر وبغرامة لا تقل عن ١٥٠,٠٠٠ درهم ولا تجاوز ٥٠٠,٠٠٠ درهم أو بإحدى هاتين العقوبتين كل من استخدم شبكة معلوماتية أو نظام معلومات إلكتروني أو إحدى وسائل تقنية المعلومات في الاعتداء على خصوصية شخص في غير الأحوال المصرح بها قانوناً."

٤.٥. أنت تقر وتفهم أن الأكاديمية تحتفظ بحقها في اتخاذ الإجراءات القانونية ضد أي فرد أو كيان يضر بالأكاديمية أو منتجاتها، بما في ذلك، على سبيل المثال لا الحصر، التوزيع غير المصرح به لمحتواها. تنطبق هذه العواقب على الأفراد داخل وخارج دولة الإمارات العربية المتحدة.
٤.٦. من خلال تقديم هويتك والتسجيل في الأكاديمية/المنتج، فإنك تؤكد موافقتك على هذه الشروط وفهمك للعواقب القانونية لأي انتهاكات.

٥. سلوك المجتمع

٥.١. أي سلوك غير أخلاقي داخل مجتمعاتنا أو تصرفات تؤثر سلبًا على الآخرين ستؤدي إلى حظر فوري من جميع المنتجات والخدمات.

٦. سياسة الاسترداد

٦.١. توفير فترة تجربة مجانية
قبل الشراء، يحصل كل عضو على فترة تجربة مجانية لمدة ٣ أيام للوصول إلى البرنامج وتجربته وتقييمه. هذه الفترة تمنح العضو الفرصة الكاملة للتأكد من صلاحية وفائدة المنتج قبل اتخاذ قرار الشراء.

٦.٢. جميع المبيعات نهائية بعد انتهاء التجربة
نظرًا لتوفير فترة التجربة المجانية وطبيعة المنتج الرقمية، فإن جميع المبيعات نهائية وغير قابلة للاسترداد بعد إتمام الدفع، باستثناء الحالات المحدودة المذكورة في البند ٦.٥.

٦.٣. الموافقة الإلزامية عند الدفع
عند إتمام عملية الدفع، يجب على العضو تحديد مربع الموافقة الذي يؤكد أنه قد قرأ ووافق على هذه الشروط والأحكام. وبذلك، يقر العضو بما يلي:

  • أنه استفاد من فترة التجربة المجانية لتقييم المنتج،

  • أنه فهم بوضوح أن المبالغ المدفوعة غير قابلة للاسترداد بعد الشراء،

  • أنه وافق على هذه الشروط بإرادته.

٦.٤. الأسباب غير المقبولة للاسترداد
لن يتم قبول طلبات الاسترداد في الحالات التالية، والتي لا تعتبر أسبابًا صحيحة للنزاع:

  • الادعاء بأن المنتج لم يكن مناسبًا أو لم يحقق التوقعات الشخصية.

  • الادعاء بعدم القدرة على تحقيق نتائج مماثلة للطلاب الآخرين.

  • الادعاء بعدم وجود وقت كافٍ أو دافع لإكمال البرنامج.

  • الادعاء بأن المحتوى كان متقدمًا جدًا أو بسيطًا جدًا أو غير مرغوب.

  • الادعاء بأنه تم استلام الوصول ولكن لم يتم استخدامه.

  • محاولة استهلاك كامل المحتوى ثم طلب استرداد.

٦.٥. الحالات الوحيدة المؤهلة للاسترداد
لن يتم النظر في أي طلب استرداد إلا في الحالات التالية فقط:

  • في حال عدم تسليم المنتج بالكامل (أي لم يحصل العضو على صلاحية الوصول بعد إتمام الدفع بنجاح).

  • في حال وجود مشكلات تقنية مثبتة منعت العضو من الوصول إلى المنتج، بالرغم من اتباع جميع التعليمات والتواصل مع فريق الدعم.

٦.٦. إخلاء المسؤولية للمنتجات التعليمية
يقر العضو بأن المنتج عبارة عن محتوى وخدمات رقمية. ولا يمكن "إرجاع" المنتجات الرقمية بعد الوصول إليها. لذلك، لا يمكن منح استرداد مبالغ بناءً على الرغبات أو التفضيلات الشخصية أو بعد استهلاك المحتوى.

٦.٧. الحماية ضد الاحتيال والنزاعات

  • أي محاولة لفتح نزاع (Chargeback) بعد الموافقة على هذه الشروط تعتبر احتيالًا وخرقًا للعقد.

  • ستقوم الأكاديمية بتقديم الأدلة التي تشمل: سجلات فترة التجربة، بيانات تسجيل الدخول، بيانات التقدم، إثبات اختيار مربع الموافقة، ونسخة من هذه الشروط والأحكام.

  • في حال النزاعات الاحتيالية، تحتفظ الأكاديمية بحقها في اتخاذ الإجراءات القانونية والمطالبة بالتعويضات عن الأضرار والتكاليف القانونية.

٦.٨. الموافقة النهائية
من خلال إتمام عملية الدفع بعد فترة التجربة، يؤكد العضو أنه:

  • قام بتقييم المنتج خلال فترة التجربة،

  • حصل على وقت كافٍ لاتخاذ قرار مدروس،

  • يوافق على أن جميع المبيعات نهائية وأن الاسترداد غير متاح إلا في الحالات المحدودة المذكورة في البند ٦.٥.
